机器人切除肿瘤不彻底，时隔18天二次手术，两年后患者去世；鉴定认为医院担主责

class=\"rich_media_content\"\u003e\u003cp\u003e“我丈夫体检时发现肝上有结节，没想到手术后两年去世了。”近日，广东深圳郑女士伤心地说，省医学会作出的鉴定结论显示医院承担主要责任。\u003c/p\u003e\u003cp\u003e\u003cstrong\u003e发现——\u003c/strong\u003e\u003c/p\u003e\u003cp\u003e\u003cstrong\u003e\u003c!--AIPOS_0--\u003e体检发现肝上有结节，医生确诊恶性肿瘤建议通过手术切除\u003c/strong\u003e\u003c/p\u003e\u003cp\u003e这名患者姓雷，家住广东省深圳市罗湖区。\u003c/p\u003e\u003cp\u003e妻子郑女士介绍说，丈夫身体一直非常硬朗，2021年4月份在深圳一家医院体检时发现肝上有结节，“我们看到体检报告后很重视，咨询时医生建议进一步复查，后来我们到香港大学深圳医院复查，被确诊为恶性肿瘤。”\u003c/p\u003e\u003cp\u003e郑女士告诉华商报大风新闻记者，为了进一步弄清楚情况，他们还到上海瑞金医院做了检查，结论与香港大学深圳医院是一样的，医生都建议通过手术及早切除。\u003c/p\u003e\u003cp\u003e“随后，我们挂了香港大学深圳医院肝胆胰外科纪姓医生的专家号，他说这个手术可以通过\u003c!--VERTICAL_CARD_BEGIN_0--\u003e达芬奇机器人\u003c!--VERTICAL_CARD_END_0--\u003e辅助完成。”郑女士说，“纪医生还说用机器人做手术定位是非常准确的，这也是他们最大的优势。”\u003c/p\u003e\u003cp\u003e她说，对比各大医院后，考虑到他们家在深圳方便照顾，他们更多的是相信该医院的实力，经全家人商量，最终决定在\u003c!--SECURE_LINK_BEGIN_0--\u003e香港大学深圳医院\u003c!--SECURE_LINK_END_0--\u003e做手术。\u003c/p\u003e\u003cp center\"\u003e\u003c!--IMG_0--\u003e\u003c/p\u003e\u003cp\u003e\u003cstrong\u003e手术——\u003c/strong\u003e\u003c/p\u003e\u003cp\u003e\u003cstrong\u003e\u003c!--AIPOS_1--\u003e达芬奇机器人切除肿瘤后医护人员称成功了，患者家属感动哭了\u003c/strong\u003e\u003c/p\u003e\u003cp\u003e郑女士告诉记者，当初医生说那是个微创手术，大约一小时就可以做好，由达芬奇机器人辅助完成。\u003c/p\u003e\u003cp\u003e“2021年5月6日上午9点左右，我丈夫被推进手术室，直到下午3点左右才推出来，当天我们一直守候在手术室门外。”郑女士回忆说，期间他们十分焦急，不知道手术过程中究竟发生了什么事。\u003c/p\u003e\u003cp\u003e手术记录显示，手术截止时间是当天下午1：52，持续了大约5小时，手术名称是“机器人辅助肝S5楔形切除+胆囊切除术”，手术医生姓纪，另一人姓樊，在全麻下做的手术。\u003c/p\u003e\u003cp\u003e郑女士回忆说，当天丈夫被推出来时，医护人员见到他们连说“手术成功了，手术很满意”，“我听到后非常高兴，感动得哭了，治疗4天后出院。”\u003c/p\u003e\u003cp\u003e病历还显示，同年5月18日，雷先生再次入院治疗，查出“肝脏S5结节切除术后改变，局部包裹积液，肝周少量积液，右侧腹壁皮下水肿”等。\u003c/p\u003e\u003cp\u003e\u003cstrong\u003e去世——\u003c/strong\u003e\u003c/p\u003e\u003cp\u003e\u003cstrong\u003e\u003c!--AIPOS_2--\u003e时隔18天后再施手术，两年后不幸去世，妻子曾卖房救夫\u003c/strong\u003e\u003c/p\u003e\u003cp\u003e\u003c/p\u003e\u003cp\u003e郑女士说，2021年5月24日，距达芬奇机器人手术之后第18天，在全麻情况下，医生第二次给丈夫做了“右肝前叶切除术+肝门部淋巴结廓清术”，“这次是医生自己做的手术，同年6月7日出院。”\u003c/p\u003e\u003cp\u003e她说，丈夫后来多次在该医院住院治疗，2023年12月27日，在\u003c!--SECURE_LINK_BEGIN_1--\u003e深圳市第二人民医院\u003c!--SECURE_LINK_END_1--\u003e去世，时年67岁。\u003c/p\u003e\u003cp\u003e郑女士伤心地回忆说，这些年来为了给丈夫治病，他们家卖掉房子凑钱，当初买了24万余元一支的进口药救治，最终还是未能挽回他的生命。\u003c/p\u003e\u003cp\u003e\u003cstrong\u003e争议——\u003c/strong\u003e\u003c/p\u003e\u003cp\u003e\u003cstrong\u003e\u003c!--AIPOS_3--\u003e家属认为医院实施手术时有失误，医院辩称不属于医疗事故\u003c/strong\u003e\u003c/p\u003e\u003cp\u003e\u003c/p\u003e\u003cp\u003e雷先生去世后，家人认为香港大学深圳医院当初在第一次达芬奇机器人手术过程中存在严重失误，未能完整切除他的肝部肿瘤，称医方在明知首次手术未能将他肿瘤完全切除情况下，未及时安排他入院进行第二次手术，导致他的癌细胞广泛扩散被迫化疗。\u003c/p\u003e\u003cp\u003e他们同时还认为，做手术的纪医生不具备操作达芬奇机器人实施外科手术的能力，认为医方的医疗过错行为直接造成患者死亡的严重后果，已构成医疗事故。\u003c/p\u003e\u003cp\u003e医院认为诊断正确，依据充分，患者雷先生有行“机器人辅助肝S5楔形切除+胆囊切除术”的明确手术指征，手术前告知充分，医生手术操作正确，在发现第一次手术肿瘤清除不彻底后，医院及时采取补救措施进行第二次手术，二次术后达到\u003c!--VERTICAL_CARD_BEGIN_1--\u003e根治性切除\u003c!--VERTICAL_CARD_END_1--\u003e标准。\u003c/p\u003e\u003cp\u003e医院称，雷先生病情复发、扩散与第一次手术之间无因果关系，死亡不是该案的损害后果，“他第一次手术未能完全清除肿瘤，为其自身疾病特点导致，且受限于当今医学技术，属于难以完全避免的情形，亦属医疗机构免责情形，不属于医疗事故。”\u003c/p\u003e\u003cp\u003e\u003cstrong\u003e鉴定——\u003c/strong\u003e\u003c/p\u003e\u003cp\u003e\u003cstrong\u003e\u003c!--AIPOS_4--\u003e用达芬奇机器人做手术未及时发现肿瘤遗漏，医院承担主要责任\u003c/strong\u003e\u003c/p\u003e\u003cp\u003e事发后，雷先生的家人向深圳市卫健委反映，认为香港大学深圳医院负有不可推卸的责任。\u003c/p\u003e\u003cp\u003e2025年11月3日，深圳市卫健委委托广东省医学会对此事做医疗事故技术鉴定。\u003c/p\u003e\u003cp\u003e鉴定组专家认为，该医院的医疗过失主要表现在两个方面。\u003c/p\u003e\u003cp\u003e首先，用“达芬奇机器人做第一次手术时未行\u003c!--VERTICAL_CARD_BEGIN_2--\u003e冰冻病理检查\u003c!--VERTICAL_CARD_END_2--\u003e”，当初纪医生等人给雷先生做“机器人辅助肝S5楔形切除+胆囊切除术”时，手术定位欠精准，术中未能完全规避定位偏差，术中未能有效完整切除肿瘤，术中未行冰冻病理检查，未能及时发现肿瘤遗漏，以致患者在18天后行第二次手术治疗。\u003c!--MID_AD_0--\u003e\u003c!--EOP_0--\u003e\u003c/p\u003e\u003c!--PARAGRAPH_0--\u003e\u003cp\u003e其次，医院对患者雷先生缺乏明确辅助治疗的建议。\u003c/p\u003e\u003cp\u003e鉴定组专家称，2021年5月13日，雷先生的术后病理报告提示“胆囊”未见明显恶性证据等，表明其中一灶为\u003c!--VERTICAL_CARD_BEGIN_3--\u003e门静脉内癌栓\u003c!--VERTICAL_CARD_END_3--\u003e，属于高危术后复发风险，临床上应建议患者行辅助综合治疗、密切复查较为妥当，而医方仅在出院医嘱中建议“术后一个月来门诊复查，肝胆外科门诊随诊”，过于简单。\u003c!--MID_AD_1--\u003e\u003c!--EOP_1--\u003e\u003c/p\u003e\u003c!--PARAGRAPH_1--\u003e\u003cp\u003e鉴定组专家还对医方的医疗过失与患者损害后果之间的因果关系及责任程度进行了分析。\u003c/p\u003e\u003cp\u003e他们认为，医方在使用“达芬奇机器人”施行首次术中未能规避定位偏差，切缘阳性，未达到根治性切除目标，存在遗漏肿瘤，导致患者需行二次手术切除肿瘤，医方的医疗过失行为与患者需行二次手术的损害后果之间存在因果关系，该医案构成\u003c!--VERTICAL_CARD_BEGIN_4--\u003e四级医疗事故\u003c!--VERTICAL_CARD_END_4--\u003e，综合考虑患者自身疾病因素和医方过失程度等，医方的医疗过失对患者需行二次手术的损害后果原因力大小为主要原因，应承担主要责任。\u003c!--MID_AD_2--\u003e\u003c!--EOP_2--\u003e\u003c/p\u003e\u003c!--PARAGRAPH_2--\u003e\u003cp\u003e2025年12月22日，广东省医学会出具鉴定结论称，根据相关规定，该例属于医疗事故，医疗事故等级为四级，医方承担主要责任。\u003c/p\u003e\u003cp style=\"text-align: center\"\u003e\u003c!--IMG_2--\u003e\u003c/p\u003e\u003cp\u003e事发后，广东中一司法鉴定中心出具司法鉴定意见书称，香港大学深圳医院在张老太的诊疗过程中存在术前诊断依据不足，手术方式选择不妥，对于手术方式的选择未与她家属充分沟通，术中未发现病灶时没有对手术方式进行重新评估的过错，医方过错与张老太的不良治疗后果存在主要因果关系，责任参与度为61%-90%。\u003c/p\u003e\u003cp style=\"text-align: center\"\u003e\u003c!--IMG_3--\u003e\u003c/p\u003e\u003cp\u003e2022年1月11日，深圳市福田区法院一审宣判称，香港大学深圳医院担责八成，赔偿张老太家人包括精神损害抚慰金等在内的各种费用共计47万余元。\u003c/p\u003e\u003cp\u003e一审宣判后，双方均不服，上诉至深圳市中级法院。\u003c/p\u003e\u003cp\u003e该法院审理后认为，香港大学深圳医院在“术中未发现病灶时”，既未加以关注并对手术方式进行重新评估，也未及时向患者或患者近亲属说明医疗风险、替代医疗方案等情况，侵害患方的知情同意权；再者，患者高龄，并有高血压病史，在无明显恶性肿瘤组织学证据下，行“全胰切除术”，手术创伤巨大且对患者的全身营养代谢及水电平衡产生严重影响，患者死亡与手术方式的选择有一定关系。\u003c!--MID_AD_3--\u003e\u003c!--EOP_3--\u003e\u003c/p\u003e\u003c!--PARAGRAPH_3--\u003e\u003cp\u003e该法院称，该医院在诊疗过程中没有尽到高度注意义务，致使患者未能避免本可避免的不良后果，丧失了接受适当治疗的机会及生存可能性，“本院认定香港大学深圳医院向赔偿权利人承担全部赔偿责任。”\u003c/p\u003e\u003cp\u003e2023年11月28日，深圳市中级法院终审判决该医院赔偿张老太家人各类费用约63万元。\u003c/p\u003e\u003cp\u003e张老太的女儿告诉华商报大风新闻记者，他们对这样的判决结果感到满意，但认为应该追究当初给母亲主刀的纪医生的刑事责任，并向深圳市公安局福田分局报案，还委托北京安剑律师事务所知名律师周兆成代理该案。\u003c/p\u003e\u003cp\u003e2024年6月，福田公安分局委托深圳市医学会对张老太与香港大学深圳医院的医疗事故争议案进行医疗事故技术鉴定，主要内容是医方的诊断治疗过程是否存在医疗过失，张老太是否存在损害后果，其损害后果是什么，她的损害后果与医方的过失行为之间是否有因果关系，该案是否属于医疗事故？\u003c!--MID_AD_4--\u003e\u003c!--EOP_4--\u003e\u003c/p\u003e\u003c!--PARAGRAPH_4--\u003e\u003cp\u003e2026年3月9日，深圳市医学会出具医疗事故技术鉴定书，鉴定结论是，根据《医疗事故处理条例》《医疗事故技术鉴定暂行办法》《医疗事故分级标准（试行）》等规定，该例属于一级甲等医疗事故，医方承担次要责任。\u003c/p\u003e\u003cp
